Terms of Service

TodAidesign (todaidesign.net, the “Platform”) is operated by Todae, Republic of South Africa (“Todae”, “we”, “us”). These Terms of Service (“Terms”) govern your access to and use of the Platform, including: (a) the browser-based security design software and calculators; (b) done-for-you design orders; (c) equipment carts fulfilled by the Todae store; and (d) the certified installer marketplace. By creating an account or using the Platform you agree to these Terms and to our Privacy Policy.

If you use the Platform on behalf of a company, you confirm you are authorised to bind that company, and “you” means that company.

You must provide accurate registration information and keep your credentials secure; you are responsible for activity under your account. You must be at least 18 years old (or the age of legal capacity in your jurisdiction) to transact on the Platform. We may suspend accounts that breach these Terms, abuse the service, or create risk for other users.

The design software is offered on a permanent Free plan and paid subscription tiers as described on the pricing page. Prices are stated in US dollars unless indicated otherwise. Payments are processed by Stripe; we do not store card details.

Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from the billing portal — cancellation takes effect at the end of the paid period, and features gated to your tier revert to the Free plan afterwards. Statutory refund rights (including under the South African Consumer Protection Act and Electronic Communications and Transactions Act, where applicable) are not affected.

Design orders (a fixed-fee service where our team prepares a security design from your brief) are delivered into your account as an editable project. The listed fee includes the number of revisions shown at order time; further revisions are charged at the listed revision fee. Delivery timelines are estimates, not guarantees.

Equipment carts assembled on the Platform are fulfilled by the Todae store as the seller of record. Product availability, final pricing, shipping, warranty and returns for equipment orders are governed by the Todae store's terms presented at checkout. Prices and totals shown inside the Platform before checkout are estimates derived from current price lists (excl. VAT unless stated) and may be adjusted at checkout.

Certified installers are independent contractors, not employees, agents or partners of Todae. The Platform brokers the connection: customers post installation jobs derived from their designs; certified installers claim and perform them. Certification reflects the documents an installer submitted at review time — it is not a guarantee of workmanship. The contract for installation work is between the customer and the installer; Todae facilitates scheduling, scope and payout accounting.

Installer payouts are calculated at the published payout share of the job value and settled after customer sign-off. Installers are responsible for their own taxes, insurance, licensing and compliance with local electrical/security regulations.

Coverage previews, DORI/IEC 62676-4 overlays, detection ranges, BOMs, storage/power calculations and generated documents are computed from manufacturer specifications and your inputs. They are planning aids — not a substitute for a professional site survey, and not a certification of regulatory compliance. You remain responsible for verifying designs against site conditions and applicable law (including privacy law governing camera placement) before installation.

You agree not to:

• use the Platform to plan unlawful surveillance or violate others' privacy rights;
• probe, disrupt or overload the service, or access data that isn't yours;
• scrape, resell or redistribute the catalog, pricing data or generated content as a competing service;
• upload malicious content or content you have no right to use;
• misrepresent certification status or post fraudulent jobs on the marketplace.

You retain ownership of designs, floor plans and other content you create or upload. You grant us the licence needed to host, process and display that content to operate the service (including sharing a design with an installer you engage or with our design team for an order you place). The Platform, its software, catalog structure and branding remain the property of Todae and its licensors.

The Platform is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim implied warranties and our total liability arising out of or relating to the Platform in any 12-month period is limited to the greater of the fees you paid us in that period or USD 100. We are not liable for indirect or consequential loss, loss of profits, or losses arising from equipment supplied by third parties or work performed by installers. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory rights under the South African Consumer Protection Act.

You may stop using the Platform and delete your account at any time (Settings → Delete account). We may terminate or suspend access for material breach of these Terms. Sections that by nature survive termination (IP, disclaimers, liability limits) survive.

These Terms are governed by the laws of the Republic of South Africa, without prejudice to mandatory consumer protections of your country of residence. Disputes will be resolved by the competent South African courts unless applicable law gives you the right to sue at home.

We may update these Terms; material changes will be announced in the app or by email, and the “Last updated” date revised. Continued use after changes take effect constitutes acceptance.
